These Terms of Service (the “Terms”) set forth the conditions for the use of the services provided on this website by never knows heart (the “Shop”).
Users shall use the Shop only after agreeing to these Terms.
1. Scope of Application
1.1 These Terms shall apply to all relationships between the User and the Shop relating to the use of the Shop and the purchase of products.
2. Agreement to the Terms
2.1 By purchasing any product from the Shop, the User is deemed to have agreed to these Terms as well as all other policies separately established by the Shop, including but not limited to the Refund and Return Policy.
3. Usage Restrictions and Registration Information
3.1 The Shop may impose restrictions on order amounts, order frequency, or other conditions per User, either per transaction or within a specified period.
3.2 The Shop reserves the right, at its sole discretion and based on registration information, order history, or other relevant circumstances, to refuse an order or restrict future use of the Shop.
3.3 Users are required to register an account in order to place orders on the Shop. Account registration is free of charge. Users are responsible for keeping their registration information accurate and up to date through the My Account page.
4. Prohibited Conduct
4.1 Users shall not engage in the following activities:
4.1.1 Acts that violate laws or public order and morals
4.1.2 Providing false or inaccurate information
4.1.3 Impersonating a third party
4.1.4 Using fraudulent or inappropriate payment methods
4.1.5 Interfering with or disrupting the operation of the Shop
4.1.6 Any other conduct deemed inappropriate by the Shop
4.2 If the Shop determines that a User has engaged in any of the above activities, the Shop may, without prior notice, refuse transactions or suspend the User’s access to the Shop.
5. Formation of Sales Contract
5.1 Users may purchase products through the methods designated by the Shop.
5.2 A sales contract shall be deemed concluded at the time when the Shop sends an order confirmation notice to the User.
5.3 The Shop reserves the right to cancel or terminate a contract after its conclusion due to inventory availability, payment issues, legal compliance requirements, suspected fraudulent activity, or other reasonable grounds.
5.4 After payment confirmation, order cancellations may be subject to conditions, fees, and limitations as separately set forth in the Shop’s Refund and Return Policy.
6. Payment Methods
6.1 Payment methods shall be limited to credit card payments or other methods specified by the Shop.
6.2 The Shop uses an external payment processing service (Stripe) for payment processing.
6.3 Users acknowledge in advance that payment and refund processing shall be handled in accordance with the rules and policies of the external payment service provider and the relevant credit card companies.
7. International Shipping and Import Charges
7.1 Products sold by the Shop may be shipped internationally outside Japan.
7.2 The Shop ships products under the DDU (DAP) delivery method.
7.3 All customs duties, import taxes, customs clearance fees, and any other charges incurred upon importation shall be borne by the recipient User.
7.4 Such charges may be collected at the time of delivery by the shipping carrier or through the customs authorities of the destination country.
7.5 The Shop does not guarantee or provide advance estimates of the exact amounts of such charges.
8. Returns and Refunds
8.1 Conditions, procedures, and deadlines for returns and refunds shall be governed by the Shop’s separately established Refund and Return Policy.
8.2 In the event of any inconsistency between these Terms and the Refund and Return Policy, the Refund and Return Policy shall prevail.
8.3 The Shop may attach a protective tag to products prior to shipment. Removal of such protective tags shall be deemed as use of the product and will render the item ineligible for return or refund, except where required by law.
8.4 Depending on the circumstances, the Shop may require returned items to be shipped back to Japan at the User’s expense.
9. Products and Legal Compliance
9.1 The Shop handles only products that comply with applicable export and import laws, international treaties, and regulations.
9.2 The Shop may change product offerings, sales conditions, or sales regions without prior notice in order to comply with such laws and regulations.
9.3 The Shop operates as a cross-border purchasing agent for certain products available in Japan. Products are procured after an order is placed and shipped directly to the User.
10. Intellectual Property Rights
10.1 All intellectual property rights relating to text, images, designs, and other content displayed on the Shop belong to the Shop or the respective rightful owners.
10.2 Unauthorized reproduction, copying, modification, or other use of such content is strictly prohibited.
11. Disclaimer
11.1 The Shop shall not be liable for any damages arising from natural disasters, communication failures, system malfunctions, or other force majeure events.
11.2 Except as required by applicable law, the Shop makes no express or implied warranties regarding its products.
11.3 The Shop shall not be involved in or liable for any disputes arising between Users or between a User and a third party.
11.4 The Shop shall not be liable for delays, confiscation, returns, refusal of receipt, or additional charges arising from international shipping or customs procedures.
12. Modification or Suspension of Services
12.1 The Shop may modify, suspend, or terminate all or part of its services without prior notice to Users.
13. Amendments to the Terms
13.1 The Shop may amend these Terms when deemed necessary.
13.2 Amended Terms shall become effective upon being posted on the Shop’s website.
14. Governing Law and Jurisdiction
14.1 These Terms shall be governed by and construed in accordance with the laws of Japan.
14.2 Any disputes arising out of or in connection with the Shop or these Terms shall be subject to the exclusive jurisdiction of the Tokyo District Court.
15. Coupon Usage and Validity
15.1 Coupons issued by the Shop are valid only under the conditions specified at the time of issuance.
15.2 Coupons used in an order that is canceled prior to shipment may be revalidated at the Shop’s discretion.
15.3 Coupons used in an order that has been delivered and subsequently returned shall, in principle, be deemed used and shall not be reissued.
15.4 Notwithstanding the preceding paragraph, the Shop may, at its sole discretion, issue alternative or goodwill coupons on a case-by-case basis.
